The Remaining Relative visa (Subclass 115) offers permanent residency in Australia for individuals who have no close family members living outside Australia. It is intended for people whose entire immediate family such as parents, siblings, or children, have already permanently settled in Australia, leaving them as the sole remaining relative overseas.

Applicants must be outside Australia both when they submit the visa application and at the time the visa is granted.

To qualify, applicants must meet strict conditions:

  • All Near Relatives in Australia: You (and your partner, if applicable) must have all near relatives permanently living in Australia as citizens, permanent residents, or eligible New Zealand citizens. No near relatives can reside outside Australia.
  • Sponsorship: You must be sponsored by an eligible near relative (or their partner), aged 18 or older, willing to sponsor you and any family included in your application.
  • Assurance of Support (AoS): A sponsor must provide a legal commitment to financially support you, ensuring you won’t rely on Australia’s social security. A refundable bond may be required.
  • Health and Character: You and any dependents must meet Australia’s health and character standards.

  • Your child/stepchild under 18 not in your or your partner’s daily care

The Department of Home Affairs assesses near-relative status based strictly on defined relationships, not emotional closeness or contact.

 

Health and Character Requirements

All applicants (including dependents) must:

  • Meet health requirements, with medical exams usually valid for 12 months

  • Provide police certificates for each country lived in for 12+ months in the past 10 years (if aged 16 or over), when requested by the Department

 

Adding Family Members to your  Application

You may include the following eligible family members at the time of application submission:

  • Your spouse or de facto partner

  • Your children or your partner’s children/stepchildren

 

Important Considerations

The Remaining Relative visa is subject to capping and queuing, meaning only a limited number of visas are granted each year. As a result, processing times can be extremely lengthy, often stretching into many years or even decades.
