The Prospective Marriage Visa (Subclass 300) commonly known as the fiancé visa, is a temporary visa for individuals who are engaged to an Australian citizen, permanent resident, or eligible New Zealand citizen and intend to marry them.

This visa permits the applicant to enter and stay in Australia for 9 to 15 months, during which the marriage must take place. Once married, the visa holder becomes eligible to apply for the Partner visa (Subclass 820 and 801) as the next step toward permanent residency in Australia.

Eligibility Criteria

For Visa Applicants:

To be eligible for the Subclass 300 visa, you must:

  • Be 18 years old or more at the time of lodging your application.
  • Be outside Australia both when you lodge your application and when the visa decision is made.
  • Meet the relationship criteria: You must be in a genuine relationship with your prospective spouse, have met them in person as adults (after both turning 18), and genuinely intend to marry them within the visa validity period and live together as spouses. You must also demonstrate that you are personally known to each other.
  • Be sponsored by your fiancé/fiancée, who must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.
  • Meet Australia’s health and character requirements.
  • Have no outstanding debts to the Australian Government, or have made satisfactory arrangements to repay any debts before the visa is granted.
  • There must be no legal impediment to your marriage in Australia.
  • You should provide evidence of your intention to marry, such as a Notice of Intention to Marry (NOIM) lodged with an authorised marriage celebrant.

 

For Sponsors:

To be an eligible sponsor for the Prospective Marriage visa, you must:

  • Be the fiancé/fiancée of the visa applicant.
  • Be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.
  • Be 18 years old or more.
  • Not hold or have held certain visas (e.g., if you were previously sponsored on a partner visa yourself within a certain timeframe).
  • Meet specific character requirements, providing police clearances as proof.
  • Take responsibility for:
    • Any money your fiancé/fiancée owes the Australian Government.
    • Your fiancé/fiancée’s obligations regarding their employment in Australia.
    • Your fiancé/fiancée’s compliance with the conditions of their visa.
    • Providing accommodation and financial assistance to your fiancé/fiancée during their stay on the Subclass 300 visa.

Adding Family Members

You may include your dependent children or step-children in your Prospective Marriage visa application. If approved, they will receive the same rights and conditions as the primary visa holder. Note that specific eligibility requirements apply, especially for dependents over the age of 18.
