The Partner Visa (Subclasses 309 and 100) allows individuals who are married to or in a de facto relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. This visa is processed in two stages. First, the temporary Subclass 309 (Partner Provisional) visa is granted, allowing the applicant to stay in Australia while their permanent visa is assessed. After meeting specific eligibility requirements and demonstrating that the relationship is genuine and ongoing, the applicant may be granted the permanent Subclass 100 (Partner Migrant) visa. Both stages are applied for together through a single application and fee.
Four Pillars of Partner Visa
The four key pillars (criteria) of the Partner Visa (Subclass 309/100) that the Department of Home Affairs uses to assess the genuineness of the relationship are:
1. Financial Aspects of the Relationship
- Joint financial responsibilities (shared accounts, assets, loans, or bills)
- Evidence of financial support between partners
- How finances are managed day-to-day
2. Nature of the Household
- Living arrangements and daily household duties
- Evidence of shared responsibilities (e.g., utility bills, lease agreements, mail addressed to both)

Social Aspects of the Relationship
- Recognition of the relationship by family, friends, and the wider community
- Joint social activities, photos, travel together
- Invitations, statements from friends/family, joint memberships

Nature of the Commitment
- Duration and history of the relationship
- Future plans together
- Communication records, travel history, or time spent apart
- Emotional support and commitment to a shared life

Eligibility Criteria
Eligibility Criteria for Partner (Provisional) Visa (Subclass 309):
To be eligible for the Subclass 309 visa, you must:
- Be outside Australia both when you lodge your application and when the visa decision is made.
- Be in a genuine and continuing relationship as the spouse or de facto partner of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.
- Be at least 18 years of age or older when you apply (applies to both married and de facto partners).
- Have your partner sponsor you. If your Australian partner is under 18 years of age, their parent or guardian (who must be an Australian citizen, permanent resident, or eligible New Zealand citizen) can sponsor you.
- Meet Australia’s health and character requirements.
- Have no outstanding debts to the Australian government, or have arranged to repay any debts before the visa is granted.
- Not have had a visa cancelled or an application refused in certain circumstances (this will be considered).
Eligibility Criteria for Partner (Migrant) Visa (Subclass 100):
To be eligible for the Subclass 100 visa, you must:
- You may be inside or outside Australia when the decision on the Subclass 100 visa is made.
- Hold a temporary Partner (Provisional) visa (Subclass 309).
- Continue to be in a genuine and continuing marriage or de facto relationship with your sponsor, unless special circumstances apply (e.g., relationship breakdown due to family violence or death of the sponsor).
- Have complied with all Australian laws and the conditions of your temporary Subclass 309 visa.
- Have fulfilled the two-year waiting period since your combined 309/100 application was lodged (this period may be shorter for long-term relationships or relationships with dependent children).
Health and Character Requirements:
For both the Subclass 309 (temporary) and Subclass 100 (permanent) partner visas, you and any family members included in the application must:
- Complete required medical examinations, usually within 12 months of lodging the application.
- Submit police clearance certificates from each country where you have lived for 12 months or more in the past 10 years since turning 16.
Sponsor Responsibilities:
As a sponsor, you are required to support your partner for two years from the date they arrive in Australia on the Subclass 309 visa. Your responsibilities may include:
- Providing suitable accommodation.
- Offering financial support, including costs for English language training if needed.
- Assisting with other essential needs, such as childcare, if applicable.
Note: Sponsorship limits apply. You may only sponsor up to two partners in your lifetime and must wait five years between sponsorships (with some exceptions).
Adding Family Members:
You may include your dependent children or stepchildren in the application. Additional eligibility conditions apply, especially for children over the age of 18.
