The Australian Child Visa program (Subclass 802/101) allows eligible parents to sponsor their child for permanent residency.

  • Subclass 802 (Onshore Child Visa): For children applying within Australia
  • Subclass 101(Offshore Child Visa): For children applying from outside Australia
  •  

Both visas support family reunification and provide access to healthcare, education, and a pathway to citizenship.

 

Eligibility Criteria 

Child

The child must:

  • Be sponsored by a parent or the parent’s partner

  • Be single, not engaged and not in a de facto relationship

  • Be either under 18, a financially dependent full-time student aged 18–25, or over 18 with a disability that prevents work and relies on the sponsor. May include their own dependent children in the application

 

Parent (Sponsor)

The sponsoring parent must:

  • Be an Australian citizen, permanent resident, or eligible New Zealand citizen

  • Be the child’s biological, step, or adoptive parent

  • Be at least 18 years old

  • Retain legal responsibility (for step-parents no longer with the child’s biological parent, if the child is under 18)

Note: If the child was adopted after the sponsor became an Australian citizen/resident, they may need to apply under Subclass 102 (Adoption Visa).

Benefits of Child Visas

These are permanent residence visas, granting the child significant benefits, including the right to:

  • Stay in Australia indefinitely.

  • Enroll in Medicare, Australia’s national scheme for health-related care and expenses.
  • Apply for Australian citizenship once they become eligible.
  • Sponsor eligible relatives for permanent residence in the future.
  • Travel to and from Australia for five years from the date the visa is granted. After this initial period, a Resident Return Visa (RRV) will be required for re-entry as a permanent resident, or they can apply for Australian citizenship.

Sponsor Responsibilities

Sponsors are responsible for supporting the child’s successful settlement in Australia. Key duties include:

  • Covering any government costs related to the child’s welfare
  • Providing housing, financial support, and a reasonable standard of living for the first two years
  • Helping the child adjust to life in Australia
  • Supporting the child’s participation in English language programs

 

Additional Responsibilities (for Children Under 18)

If the child is under 18, sponsors must also:

  • Provide written consent from all legal guardians
  • Obtain legal permission from the child’s home country to migrate
  • Submit evidence that relocation doesn’t breach any Australian court custody orders

 

Other Key Requirements

Health:

  • The child and dependents must meet health standards
  • Medical exams are valid for 12 months

Character:

  • Required for children aged 16+
  • Police clearances may be requested for countries lived in for 12+ months in the past 10 years after turning 16
