The Australian Adoption Visa (Subclass 102) provides a permanent migration pathway for children who have been adopted, or are in the process of being adopted, by an Australian citizen, Australian permanent resident, or an eligible New Zealand citizen.
In most cases, the adoptive or prospective adoptive parent submits the visa application on behalf of the child and also serves as their sponsor. Importantly, if an adoption is being arranged through an Australian state or territory adoption authority, the visa application may be lodged even before the adoption is legally finalized.
Eligibility Criteria
Adoptive Parents (Sponsors)
To sponsor a child under the Adoption Visa (Subclass 102), the adoptive or prospective adoptive parent must:

Be at least 18 years old.

Be the adoptive or prospective adoptive parent of the child.

Be an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen.
In addition, the adoption process must satisfy certain requirements:

The child must be adopted or in the process of being adopted with the involvement of an Australian state or territory adoption authority.

If the adoption took place outside Australia, it must have been completed in accordance with the adoption laws of that country.

If the adoption is occurring within Australia, the approval is only valid if the child’s country of origin has signed:

The Hague Adoption Convention, or
-
A Bilateral Agreement with Australia.

Eligibility Criteria
Child (Applicant)
To be eligible for the Adoption Visa, the child must:

Be under 18 years of age at the time the application is submitted.

Be outside Australia both when the application is lodged and when the visa is granted.

Be already adopted, or in the process of being adopted by the sponsoring parent.

Satisfy Australia’s health and character requirements.
-
Possibly provide an Assurance of Support, if requested.
Note: If the child turns 18 after the application is lodged but before the visa is granted, they will no longer be eligible for this visa.
Visa Class
Benefits of Adoption Visa
Once granted, the Adoption Visa offers significant benefits, as it is a permanent residence visa. It allows the adopted child to:
- Live, study, and work in Australia indefinitely.
- Access Medicare, Australia’s national scheme for health-related care and expenses.
- Apply for Australian citizenship once they meet the eligibility criteria.
- Sponsor eligible relatives for permanent residence in the future.
- Travel to and from Australia for five years from the date the visa is granted. After this period, they will need to apply for a Resident Return Visa (RRV) to re-enter Australia as a permanent resident, or obtain Australian citizenship.
Best Interests of Child
In line with Australian adoption and immigration policies, the best interests of the child are a primary consideration. An Adoption Visa will generally not be granted if doing so is considered contrary to the welfare of a child under 18. Child protection measures are an essential part of the visa assessment process.
Adding Family Members in the Application
The main applicant (the adopted child) may include their dependent children in the visa application.

Siblings of the adopted child who also wish to migrate must lodge separate visa applications.

Every dependent included in the application must meet the health and character requirements.
Health and Character Requirements
The adoptive parent(s) and all family members listed in the application must:

Complete medical examinations within 12 months prior to visa lodgement.

If aged 16 or older, provide police clearance certificates for each country where they have lived for more than 12 months over the past 10 years (after turning 16).
